These Terms of Service ("Terms") govern your access to and use of KleinHub AI ("KleinHub AI", "we", "our", or "us"), the AI business operating system that lets you create and run one or more businesses from a single account. By creating an account or using the Service, you agree to these Terms.
1. Your account
You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use KleinHub AI. You are responsible for the acts and omissions of team members you invite to your businesses.
2. Acceptable use
You agree not to use KleinHub AI to:
- Break the law or infringe the rights of others.
- Send spam, phishing, or deceptive messages, or violate anti-spam laws (CAN-SPAM, CASL, GDPR/PECR, etc.).
- Sell prohibited or high-risk goods and services restricted by Stripe or applicable law.
- Generate content that is illegal, defamatory, hateful, sexually explicit involving minors, or otherwise harmful.
- Reverse engineer, scrape, or overload the Service, or attempt to bypass usage or credit limits.
3. AI-generated content
KleinHub AI uses AI to generate brand, website, product, marketing, and other content on your instructions. AI output may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing AI output before publishing, sending, or relying on it, including for legal, medical, financial, or safety-critical use. We make no guarantee that AI output will produce any particular outcome, revenue, or result.
4. Ownership of AI output
As between you and KleinHub AI, and to the extent permitted by law, you own the content you generate through the Service for your businesses — including logos, website copy, product listings, and marketing assets. You grant KleinHub AI a limited license to host, display, and process that content solely to operate the Service on your behalf. You are responsible for ensuring your inputs and outputs do not infringe third-party rights.
5. Subscriptions, credits, and platform fees
KleinHub AI offers subscription tiers (Starter, Growth, Scale) billed monthly or annually, and optional credit packs. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and fees already paid are non-refundable except where required by law. Credits are consumed by AI actions per the rates disclosed in-app and generally do not expire while your account is active.
KleinHub AI uses Stripe Connect to process payments between your businesses and their end customers. KleinHub AI takes a platform fee on those transactions, disclosed in your plan. You agree to Stripe's Connected Account Agreement and Stripe Services Agreement. Payouts, chargebacks, refunds, and tax handling are governed by Stripe.
6. Your customers and end-user data
You are the controller of the customer data you upload to or collect through KleinHub AI. You are responsible for having a lawful basis to process it, providing your own privacy notices, honoring opt-outs, and complying with applicable privacy and marketing laws.
7. Email sending
KleinHub AI sends email on your behalf through our built-in provider or, if you choose, a provider you connect (e.g. Resend, SendGrid). You are responsible for the content of your emails, list hygiene, and unsubscribe compliance. We may throttle or suspend sending that generates excessive spam complaints or bounces.
8. Third-party services
The Service integrates with third parties including Supabase, Stripe, Resend, SendGrid, X (Twitter), and AI model providers. Your use of those services is governed by their own terms. We are not responsible for third-party services.
9. Suspension and termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, suspected fraud or abuse, legal risk, or provider requirements. On termination we may delete your data after a reasonable wind-down period; some data may be retained as required by law.
10. Disclaimers
THE SERVICE AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT GUARANTEE ANY BUSINESS OUTCOME, REVENUE, OR RESULT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLEINHUB AI AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.
12. Indemnification
You agree to indemnify and hold KleinHub AI harmless from claims arising out of your use of the Service, your content, your businesses' products and services, or your violation of these Terms or applicable law.
13. Changes
We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which KleinHub AI is established, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, unless applicable consumer law provides otherwise.
